The swords and edged collectibles
available are designed to be real swords.
They are not to be used in theatrical-style reenacting or cutting
exercises except where specifically named for that purpose and designed
for that specific use. While some are for display only, some practical
and functional swords are designed for soft target cutting (such as
tamashigiri - the cutting of mats) they should only be used for that
purpose by well trained professionals. Never perform cutting exercises
without proper training and supervision. It is dangerous to use Valiant
Armoury swords in any manner other than their intended purpose. Abuse or
misuse will void the warranty and endanger the user.
A. By purchasing goods from this website, Purchaser agrees to use product in legal and appropriate manner. Purchaser represents himself as of legal age, legal mind, and intending on legal intentions. Billing information and payment type will be provided via legal means, from purchaser with legal right to purchase, purchaser shall be no less than 18 yrs of age or of legal age in the area being purchased and or shipped. N.G.W will be held harmless for use by purchaser who fails any aspect of purchasing criteria. B. Purchaser agrees to assume full responsibility for compliance with all current and future applicable state and federal laws and regulations in regard to proper and legal use of product by himself or others. Next Generation Web, Inc. may not be held responsible for illegal or inappropriate use of product, including but not limited to damages resulting from improper use, illegal use, use by minor representing himself as adult, etc. Transactions and agreements with Next Generation Web, Inc. shall be construed under and according to the laws of the State of Florida, without regard to any conflict of law provisions. Client hereby agrees that any claim arising out of the products purchased hereunder shall be brought in Fort Myers, Florida in the event that Next Generation Web, Inc. shall make a claim against the customer. C. Website may not be duplicated in any manner without the express and written consent of Management. All website content including language or images, information provided via phone, email or facsimile, and including this notice may not be duplicated without written consent. All information contained herein is property of N.G.W (herein named Vendor) and any duplication of said materials will be prosecuted to the fullest extent of the law and considered infringement of intellectual property law. D. In the event of damage occurring during transport of goods to Purchaser from Vendor, Purchaser shall notify Vendor via telephone and or email within 24 hrs of receipt of merchandise. Claims for defective or damaged merchandised will not be processed if submitted more than 3 days after delivery. E. Purchaser shall indemnify, defend and hold harmless Vendor from/against loss, damages, penalties, fines, cost or expenses including, without limitation, reasonable attorney's fees and costs incurred as a result of any damage or injury to persons (including death) or property resulting from this transaction. In addition, Vendor shall not be considered liable for any special, incidental or consequential damages, including loss of income or profits resulting from use (legal or otherwise) of product. In the event N.G.W, Inc. is required to employ counsel or other means to enforce any or all website terms and conditions, N.G.W, Inc. will recover its reasonable attorney's fees, any third party fees and costs incurred in any litigation. F. All claims of fraudulent use of credit cards (including use by unauthorized person or minor) will be researched and prosecuted to the fullest extent of the law. All information provided during said incident including shipping information and address will be released to investigative and prosecuting authorities, credit card company, billing party of credit card, any public or consumer group dedicated to preventing and prosecuting credit card fraud, affiliated website partners, and may be posted on actual website. G. Purchaser will pay Vendor full compensation for product as set forth by pricing contained in this website. Prices are subject to change at any time. H. Any and all erroneous charges made by a minor will be the responsibility of the cardholder. Also, any and all erroneous charges made by any unauthorized users of a credit card due to the result of theft or loss of cardholder information will be the responsibility of the cardholder. We will not be held responsible for items sent back without authorization. Returns and Cancellations:
Claims for returns or defects must be made within three days after delivery. To return an
item, go to the Customer Service Website and click on 'Return Item'.
The Return Authorization Form must be included with return or it will be refused.
There will be a 25% processing fee on all returned items.
No refunds will be issued on used, damaged or items not returned in original
packaging. Undeliverable or
refused items will receive store credit only
minus processing fee.
Order cancellations must be submitted to customer service before the
order is shipped.
Note: All items must pass quality control and are thoroughly checked before shipping. Check your package at the time of delivery for any visible damage to the packaging. It is the responsibility of the customer to notify the carrier immediately with any loss or damage claims. It is the customers responsibility to follow up on damage and lost item claims with the carrier. All items are insured at retail value. Customer Service must be notified within 48 hours of a damage or loss claim being filed. Privacy/Spam/Abuse Policy Customer privacy is important to us. All customer information is confidentially handled. No information on our customers is sold or released to any third parties except to the extent necessary to complete the order. In a case where slander or libel may have been committed by the customer, documented customer communications may be released in our defense.
