Indemnity Agreement, Waiver of Liability, Release and Risk Assumption:

All merchandise is sold 'AS IS' without any express or implied warranties. Vendor does not warrant that any individual or company may legally purchase, possess, sell, or carry any of the items offered for sale. Vendor does not offer legal or medical advice. It is the responsibility of the purchaser, user, or recipient to comply with federal, state, and local laws. By purchasing any item, the purchaser, user, or recipient constitutes a declaration that they are of legal age to purchase the items in their jurisdiction, and at least 18 (or 21, if applicable) years of age and warrants that they are in full compliance with all federal, state, and local laws regarding the purchase, ownership, and use of the items, and that they understand and agree to all terms and conditions.

Purchaser/User Agrees to Accept Terms:

By purchasing goods, the purchaser agrees to use the product in a legal and appropriate manner. The purchaser represents themself as of legal age, of sound mind, and having legal intentions. Billing information and payment type will be provided via legal means by the purchaser with a legal right to purchase. The purchaser shall be at least 18 (or 21, if applicable) years of age in the area being purchased and shipped. The vendor will be held harmless by the purchaser who fails any aspect of the purchasing criteria.

The purchaser or user assumes full responsibility for compliance with all current and future applicable state and federal laws and regulations in regard to the proper and legal use of the product by themselves or others. The vendor may not be held responsible for illegal or inappropriate use of the product, including but not limited to damages resulting from improper use, illegal use, use by a minor representing themselves as an adult, etc. Transactions and agreements with the vendor shall be construed under and according to the laws of the State of Florida. The purchaser or user hereby agrees that any claim arising out of the products purchased hereunder shall be brought in Fort Myers, Florida, without regard to its conflict of law principles. Each party hereby irrevocably consents to the exclusive jurisdiction and venue of the state and federal courts situated in Lee County, Florida, in connection with any action arising between the parties.

The purchaser or user shall indemnify, defend, and hold harmless the vendor from or against loss, damages, penalties, fines, costs, or expenses, including, without limitation, reasonable attorney's fees and costs incurred as a result of any damage or injury to persons or property resulting from this transaction. In addition, the vendor shall not be considered liable for any special, incidental, or consequential damages, including loss of income or profits resulting from the use, legal, or otherwise of the product. In the event Vendor is required to employ counsel or other means to enforce any or all website terms and conditions, Vendor will recover reasonable attorney's fees, any third-party fees, and costs incurred in any litigation.

The website may not be duplicated in any manner without the express and written consent of management. All website content, including language or images, information provided via the internet, social media, phone, email, or facsimile, and this notice may not be duplicated without written consent. All information contained herein is property of the vendor, and any duplication of said materials will be prosecuted to the fullest extent of the law and considered an infringement of intellectual property law.

In the event of damage occurring during the transport of goods, the purchaser or user shall notify the vendor via telephone or email within three days of receiving the merchandise. Claims for defective or damaged merchandise will not be processed if submitted more than five days after delivery.

All claims of fraudulent use of credit cards, including use by an unauthorized person or minor, will be researched and prosecuted to the fullest extent of the law. All information provided during said incident, including shipping information and billing address, will be released to investigative and prosecuting authorities, credit card companies, billing parties of credit cards, any public or consumer group dedicated to preventing and prosecuting credit card fraud, and affiliated website partners, and may be posted on the actual website.

Purchaser/User will pay Vendor full compensation for product as set forth by pricing contained in this website at the time of purchase. If a price increase occurs due to manufacturer, shipping carrier costs, or any other increase, the customer will have the option to cancel the original order or proceed with payment after notification by the vendor.

Return Policy:

Contact Customer Service before returning any item.
All returns require a Return Authorization Form to be processed.
All returns must be received back to the facility within 14 days of your delivery date.
Actual (Not Discounted) shipping charges are non-refundable once the order has shipped.
Return shipping charges are the responsibility of the purchaser.
There will be a 25% processing fee on all returned, refused or undeliverable items.
No refunds will be issued on used, damaged or items not returned in original packaging.
No refunds will be issued on modified or customized items.
No refunds will be issued on Limited Edition merchandise.
We are not responsible for items returned without authorization or after 14 days.

Note:All items pass quality control and are checked before shipping. Check your package at the time of delivery for any visible damage to the packaging. It is the responsibility of the customer to notify the carrier within three days of delivery with any loss or damage claims. It is the customer's responsibility to follow up on damage and lost item claims with the carrier. All items are insured at retail value. Customer Service must be notified within five days of a damage or loss claim being filed.

Privacy/Spam/Abuse Policy

All customer information is confidentially handled. No information on our customers is sold or released to any third parties except to the extent necessary to complete the order. In a case where slander or libel may have been committed by the customer, documented customer communications may be released.

Customers shall not, nor shall they permit or assist others to abuse or fraudulently use this website, including but not limited to the following: Sending unsolicited email, obtaining or attempting to obtain products by any means with intent to avoid payment, unauthorized access or any attempt thereof to alter any information of any customers, knowingly engaging in any activities that will cause a denial of service (e.g., profanity), any attempt to interfere with the network, violating the law or aiding in any unlawful act.
